Terms of service
1. Seller and scope
The seller is Dorian SENPAU EI, trading as OUCCA Medical Systems, registered 899 691 554 R.C.S. Créteil, principal establishment 59 Avenue Aristide Briand, 94110 Arcueil, France. Contact: sales@ouccamedical.com.
OUCCA supplies professional equipment to business buyers, with Australia as its primary market. OUCCA distributes equipment through manufacturing partners and does not provide treatment services. These terms apply alongside the written quotation and accepted order documentation. They must be provided before the customer commits to an order; website wording alone is not a substitute for incorporating the agreed terms into the quotation.
2. Mandatory rights
Nothing in these terms excludes, restricts or modifies rights, guarantees or remedies which cannot lawfully be excluded, including rights under Australian Consumer Law where applicable. Purchasing for a business does not automatically remove consumer guarantees. Manufacturer warranties and OUCCA's commercial arrangements are additional to applicable mandatory rights.
3. Quotation and order agreement
An enquiry is not an order. OUCCA provides a written quotation identifying the equipment/model, supplied configuration, quoted price and currency, delivery scope, estimated timing, warranty/support arrangements, payment milestones and applicable terms. Quotations are valid for 14 calendar days from the quotation issue date. The quotation shows the issue date and expiry date; expiry is at the end of that date in the customer’s stated Australian timezone. A delayed issue on a different date requires a new quotation version.
The customer reviews and accepts the quotation in writing. OUCCA confirms the accepted order in writing. Any material variation requires written agreement. If equipment or a configuration cannot be supplied as agreed, OUCCA will discuss the available options; a substitute is not imposed without agreement. Photos of a product or branding mockup are not an accessory packing list.
For the N1 Founding Customer offer, a maximum of 15 Australian allocations is available. An enquiry, quotation, verbal acceptance or proceed action does not reserve or consume a slot. Allocation occurs only when the 40% deposit has cleared and a unique paid allocation is recorded. Founding pricing remains subject to availability at that point. If unavailable, OUCCA will not commit the supplier order or impose a higher price: it will offer a full refund of that deposit or a separately agreed written alternative.
4. Price and payment
The accepted quotation states the price, currency and any applicable taxes, duties, freight or other included/excluded charges. Website information is not a binding price. No unquoted charge is added without the customer's agreement, except where law requires it.
The standard payment arrangement is a 40% deposit, with the remaining 60% due before shipment, on the dates specified in the written order documentation. OUCCA commits the supplier order only after the deposit has been received as cleared funds. The customer should use the payment instructions on the separately verified OUCCA payment request/invoice and verify any unexpected change with OUCCA through its confirmed contact channel.
The production, QC and shipment sequence is coordinated after supplier-order commitment. The balance must be cleared before release for shipment. Payment or a payment screenshot alone does not establish cleared receipt. The quotation identifies how pre-shipment information and payment milestones relate to the specific order.
5. Made-to-order procurement and cancellation
Equipment may be manufactured, configured or imported for the accepted order. OUCCA does not offer an automatic voluntary change-of-mind cancellation or return for this order-specific equipment unless expressly agreed in writing. Any mandatory right remains unaffected.
Contact OUCCA promptly if you wish to cancel or change an order. Before supplier commitment, any refund or properly agreed, lawful incurred cost will be assessed against the actual position. Once OUCCA has committed the supplier order or incurred non-recoverable costs, the deposit may become non-refundable to the extent reasonably justified by that commitment and those costs, subject to mandatory law and any breach by OUCCA.
This is not an automatic forfeiture of the entire deposit in every case. OUCCA will assess reasonable evidenced costs, take reasonable steps to mitigate loss, and return any amount not properly required for those costs. No arbitrary penalty, duplicate recovery or unagreed cancellation charge is imposed. Any further liability beyond the deposit must have a lawful basis and be set out in the accepted agreement. Read the Returns / Cancellation Policy for the request process.
6. Production, QC and delivery
The quotation states the agreed production and delivery arrangement. Estimates are not guaranteed deadlines unless expressly agreed. Production/preparation and sea-freight transit are different periods; QC, approvals, dispatch, carrier schedules and customs conditions can affect total order-to-delivery time.
Where the quotation includes door-to-door freight, customs clearance and applicable import taxes, those inclusions must be read with the order-specific scope. The customer supplies an accurate business delivery address and relevant access information. Any unusual access, lifting, installation or onward movement requirement should be identified before order acceptance and is not assumed included.
OUCCA supplies order-specific pre-shipment information through the agreed process. The customer should inspect delivery for visible freight damage and notify OUCCA reasonably promptly, with supporting information where relevant. A failure to report within an arbitrary short period does not by itself remove mandatory rights. Do not send equipment back without coordination of a safe and appropriate route.
7. Configuration, electrical suitability and professional use
The final supplied configuration, accessories, manufacturer/model identification and available documentation are confirmed in the written order documentation. Manufacturer specifications describe equipment characteristics and do not promise clinical outcomes. A family-level regulatory entry is not presented as a model-specific certification.
The buyer is responsible for ensuring that its intended premises, operators, professional qualifications, training and intended use satisfy applicable requirements. OUCCA will provide the documentation agreed in the quotation; these terms do not excuse OUCCA from supplying equipment which meets the agreed description or applicable obligations. No Australian premises, local employees or on-site installation service are implied unless expressly included.
8. Warranty and support
AL1: confirmed two-year KES main-machine manufacturer warranty against manufacturing defects, excluding consumables. Purchaser-paid warranty shipping applies only to the commercial manufacturer warranty where lawful; it does not transfer costs that OUCCA must bear under mandatory law. OUCCA N1: three-year main-component coverage and one-year handpiece coverage; lifetime technical support is not a lifetime free-parts warranty. The product-specific written warranty reference is supplied with the quotation.
Warranty duration, covered components, handpiece coverage, exclusions and the technical support pathway depend on the system and accepted offer. The quotation and written warranty documentation govern the commercial warranty. Lifetime technical support, where included, does not mean unlimited free replacement parts, guaranteed repair times or a local on-site engineer.
Contact sales@ouccamedical.com with your order details and a description of the issue. Serial information, photographs, video or error messages can help where relevant. OUCCA remains the commercial contact and coordinates the applicable manufacturer assessment/support route. Any manufacturer process must not displace mandatory remedies owed by the seller.
9. Problems and remedies
If equipment is faulty, unsafe, materially differs from its description or otherwise fails an applicable consumer guarantee, contact OUCCA. The appropriate repair, replacement, refund or other remedy will be determined by the nature of the failure and applicable law, rather than by a blanket 'no refunds' rule. Statutory remedies are not limited to the commercial warranty period.
10. Liability and events outside reasonable control
Each party remains responsible for its obligations under the accepted agreement and applicable law. No blanket exclusion of all liability, statutory guarantees or reasonably foreseeable loss is created by these terms.
A party affected by an event outside its reasonable control should notify the other party, explain the effect and take reasonable steps to mitigate it. This does not automatically permit indefinite delay, retention of all payments or removal of statutory cancellation/remedy rights.
11. Resolving an issue
Raise concerns with sales@ouccamedical.com so that OUCCA can review the order and proposed resolution. This process does not prevent recourse to a competent regulator, court or other remedy available under applicable law. No exclusive foreign-court clause is imposed by these terms.
12. Personal information
Information used to administer the enquiry/order and support pathway is handled as described in the Privacy Policy. Contacting OUCCA or accepting an equipment quotation is not blanket consent to optional website analytics or unrelated marketing.
